Road safety, as you know, depends not only on the condition of the road surface and the adequacy / professionalism of drivers, but also on technical condition each car. Winter tires, in which cars are put on with the arrival of cold weather, is not a tribute to fashion, but a better grip of the wheels on a slippery road and, accordingly, a guarantee of safety. Neglect of this rule is fraught not only with serious traffic jams in winter, but also with an increase in the number of accidents.

Has the Law changed by 2019, and what will they be fined for?

New amendments to the Law - is winter tires obligatory in Russia in 2019-2020?

The main provisions of the Law of greatest interest to motorists:

  1. According to the new amendments, which entered into force on January 1, 2015, the concept of "winter tires" and its specific description are introduced. Also in the amendments we are talking about the permissible minimum tread depth of the tires. There is no talk about seasonal tires during the operation of cars in these changes.
  2. Since 2015, motorists can be fined for violation of the 1st part of Article 12.5 of the Administrative Code of the Russian Federation - that is, for non-compliance technical characteristics rubbers that are described in the new amendments. Moreover, the traffic police inspector, at his discretion, may not draw up a protocol, but only issue a warning.
  3. The technical regulations of the vehicle entered into force (note. “On the safety of wheeled Vehicle", TR CU 018/2011) in 2015. According to the requirement of this regulation, studded tires are prohibited for the summer season (from June to August), and summer tires for the winter season (from December to February). The term of the ban on summer tires can be changed in accordance with the climatic characteristics of the regions. For this violation, a fine has not yet been provided: nothing is said about the seasonal use of rubber in the main provisions regarding the admission of a car to operation.
  4. The concept " all season tires"Is absent in the regulations.

Technical regulations for testing winter tires - which winter tires will be tested?

The key concept is tread depth. Its own - for each type of tires for each specific vehicle in the absence of a factory wear indicator.

  1. Passenger cars, summer tires: minimum tread depth - 1.6 mm.
  2. Passenger cars, winter tires - 4 mm.

The concept of "winter tires" includes the corresponding markings - the pictogram "3-peak peak with a snowflake in the center, M & S, M + S and M S.

Restrictions for other vehicles:

  1. Category L (for ATVs, mopeds and motorcycles) - 0.8 mm.
  2. Categories N2, N3, O3, O4 ( trucks, permitted max / weight - more than 3.5 t) - 1 mm.
  3. Categories M1, N1, O1, O2 ( passenger cars) - 1.6 mm.
  4. Categories M2, M3 (buses) - 2 mm.

As for the requirements for wheel rims(absence of deformation, traces of cooking, cracks, etc.) - they are a thing of the past. But on the rubber there should be no damage - no scuffs to the cord, side cuts, uneven wear.

Conditions and malfunctions (as amended) under which the vehicle is prohibited from operating:


There is no question of the seasonality of tires in the document. But the requirements for it (winter and summer tires) are clearly spelled out (according to the technical regulations of the Customs Union):

  1. When using studded tires, they are installed on all wheels.
  2. Studded tires are prohibited from June to August.
  3. V winter period usage winter tires(installed on all wheels) mandatory.
  4. The use of unsuitable tires is prohibited.

Will there be fines for riding summer or bald tires in 2019-20?

Regular tire changes are the responsibility of any responsible driver. Annually road services remind car owners that it is better to change the tires on your car in advance - in order to avoid queues, weather force majeure and accidents. Until 2015, this procedure remained voluntary - fortunately, the owners of the cars did not seek to neglect it. But for two years now seasonal replacement of tires has been regulated by road legislation - now inspectors are fining violators for non-compliance of tires with the season.

Not only are they punished for driving summer tires on ice and snow - there is also a fine for studded tires in summer. This often comes as a surprise to novice drivers. However, spiked tires pose a road safety hazard during the warm dry season.

Why is winter tires not suitable for summer driving, and what are the sanctions provided by the rules?

Snow tires are designed very differently from standard summer tires - they are much softer in structure. When used during the summer months, they, first of all, undergo rapid wear - they quickly wear out from contact with dry asphalt, overheat during braking, melt and, as a result, increase the braking time of the car. Penalty for winter tires due precisely to the fact that such tires are dangerous both for the car on which they are installed - and for other drivers moving in the general stream.

This year, the amount of the monetary penalty is only 500 rubles - and if the inspector stops the driver with the wrong tires again, the amount of the fine will not increase. However, this is not a reason to be neglected. seasonal replacement- although the fine for 2017 studded tires is small, it is better to follow the rules and take responsibility for the safety of your car.

How exactly does the legislation define the summer and winter seasons?

Everything is simple here - the calendar winter and summer are taken as a starting point. It is prohibited to travel on ordinary "bare" tires for three winter months, on winter - from June to August inclusive. Spring and autumn do not belong to any of the categories - for example, in May, a fine for winter tires 2017 cannot be imposed, and in November the inspector will not be able to punish for summer tires.

However, it should be remembered that individual Russian regions can independently adjust this rule. For example, in the southern regions, the use of spiked tires may not be justified at all due to the absence of snow and ice. Accordingly, before traveling to warm regions on winter tires in spring or autumn, it is better to clarify what standards are in effect in the region.

Penalty for winter tiresmay be introduced very soon: the corresponding bill was recently approved by the Government of the Russian Federation. We are talking about amending article 12.5 of the Administrative Code, which establishes responsibility for driving a car under conditions prohibiting its operation.

Summer tires fine today

If speak about current situation, the issue of changing summer and winter tires in Russia is not regulated, and fines for using tires out of season have not yet been provided, and drivers change tires, focusing on weather conditions. Unspoken guidelines for changing winter tires to summer tires in central Russia are March 15, and vice versa - November 15.

However, these dates are very conditional, and they are different in different Russian regions. And, of course, when changing seasonal tires, it is reasonable to focus not only on dates, but also on the weather: if the calendar spring has come, and there is snow on the roadway, then summer tires will be completely out of place. And a dry, clean road in November does not require prompt “changing shoes” according to the winter option.

A fine for summer tires in winter - how did it all start?

Rumors that it will not be possible to "shoe" cars out of season have been going on for a long time - such initiatives have been submitted more than once to the State Duma for consideration, but for various reasons they were rejected. They, as a rule, offered the following innovations:

  • Mandatory use of winter tires in the cold months of the year - from November to March (or, alternatively, take into account the average daily temperature).
  • Introduce out-of-season tire penalties.
  • The imposition of a fine for studded tires in the summer.
  • Failure to pay insurance compensation when using the "wrong" tires, etc.

However, it does not seem that the drivers have waited: the introduction of fines for winter tires in summer and summer winter, as well as for the so-called "bald" tires has not yet been implemented. The draft amendments are still only a draft. And even the adoption of TR CU 018/2011 "On the safety of wheeled vehicles", which entered into force in 2015, which was considered a serious reason to amend the Administrative Code, did not change the situation.

Regulations and penalties for winter tires 2018 - 2019

So, the regulations of the Customs Union brought many innovations to Russian car owners. TR CU 018/2011 contains the following provisions regarding the use of rubber:

  • There is no such thing as “all-season tires” in it.
  • From December to February, it is allowed to ride on winter tires - studded or not, and from June to August on summer tires - only on non-studded ones.
  • It is prohibited to operate machines on spiked tires during the summer months.
  • It is necessary to comply with the standards for the limit wear of the tread.

Forbidden months to use seasonal tires allowed to change, they are planned to be approved by regional regulations.

As for the size of the fine, this issue has been discussed for a long time. Initially, an amount of 5,000 rubles was offered, but it was rejected. Other sizes of fines were proposed, but in the end the amount was set at 500 rubles - the use of winter tires in the summer falls under Part 1 of Art. 12.5 of the Administrative Code of the Russian Federation.

Penalty for bald tires 2018 - 2019

The use of rubber with a worn out tread, popularly called "bald", will also not go unpunished under the new rules. Although even today the driver can be fined for this violation. According to the traffic rules and its regulation on the vehicle's admission to operation, it is prohibited to enter the road if the residual tread height of a passenger car is less than 1.6 mm, a truck - 1 mm, a bus - 2 mm, a motorcycle or moped - 0.8 mm.

The fine for this offense is levied under article 12.5 of the Code of Administrative Offenses (part 1) and amounts to 500 rubles. In the future, the legislators propose to introduce a punishment of 2,000 rubles. And this increase cannot be considered unreasonable, because "bald" tires become the culprit of numerous accidents, it is especially dangerous in winter in icy conditions. "Bald" tires do not provide adequate grip, as a result of which the cars on which it is installed skid when cornering. The result is accidents, often with fatalities.

Prohibition of studded tires

In addition to seasonal bans on tires, legislative changes will also affect the use of studded tires. So, the regulation TR CU 018/2011, already familiar to us, establishes for the countries of the Customs Union:

  • Studded tires must be fitted to all wheels of the vehicle.
  • The use of studded tires is prohibited during the summer months - from June to August.
  • The maximum number of studs per running meter of the tread is 60 pieces. This requirement applies to rubber manufactured after January 1, 2016. True, a larger number of studs on the tire are also allowed, if it is established by special tests that they do not cause significant wear on the road surface and provide good adhesion properties.

As for today's fines for the use of studded tires, there are none. There is only a fine for the absence of the “Spikes” sign. It is 500 rubles.

How will the traffic police take fines for tires?

With laws and fines, everything is more or less clear, but the question remains: how will control over the observance of the above norms be carried out in practice? And who will certify the tires?

Today the only possible way determining the conformity of the seasonality of the rubber is a technical inspection. However, there are gaps here, because, for example, new cars are allowed not to undergo maintenance. The situation is also incomprehensible for old cars - after all, they are obliged to inspect only once a year, and not two.

If the amounts of fines are approved by separate norms of the Code of Administrative Offenses, car owners will have to take seriously the need to use the appropriate type of tires. Otherwise, all meetings with inspectors for the season will be able to reduce the driver's budget by an amount comparable to the cost of a set of tires, or even more.

Adoption of the law on winter tires

At the end of October 2016, among drivers, the period marked by the theme of winter tires begins. In addition to the usual conversations about where to get auto parts, the topic of a new law on rubber was added.

Disappointing news on TV channels comes from the State Duma, which says about fines for using tires that are not suitable for the season. Most auto sites claim there is no cause for concern yet.

Fine for tires out of season has existed for a long time, and as for the new bill being considered in the main legislative body, there is nothing out of the ordinary.

The Duma is in the midst of discussing the new "tire" law. Upon entry into force, new law will force car owners to have a tread depth in accordance with (not yet approved) new standards, and these efforts will last from early December to early March. To put it simply, they will be punished for driving on summer tires ah in the winter.

Another feature, worn-out winter tires are also subject to a fine. They will also be fined for driving on "thorns" on summer roads from early June to early September. In both cases the fine will be as much as 2,000 rubles.

It should be said that the new law on winter tires did not add anything new to the existing rules. Indeed, according to the existing standards, in winter, only protectors with a depth of more than 1 millimeter for passenger cars are allowed on rubber.

And when driving a car on snow and icy road sections, the depth of the rubber projector according to the regulations must be at least 4 millimeters. Apparently, in the new lawmaking, these requirements were simply toughened, although, according to the old rules, such requirements were also not new.

Why is it forbidden to use summer tires in winter?

  1. Longer braking distances due to the changed composition and pattern of the tire rubber.
  2. Lack of spikes on the rubber.
  3. The handling of the car is reduced due to the deterioration of wheel traction on ice and snow.

Precisely what was not in the old rules were references to tire seasonality, but similar clauses were contained in other regulations. The law did not enforce a fine for summer tires in winter until 2015, although there were attempts to implement it in 2013. Those regulations, adopted by the Customs Union in 2014, impose a fine for driving on off-season tires.

According to the regulations, the use of summer tires is prohibited in winter, from December to February, and vice versa, in the summer from June to August, driving on winter tires is unacceptable.

Why is it forbidden to use winter tires in summer?

  1. The braking distance is increased due to the sliding of metal spikes on the asphalt surface
  2. Studded rubber damages the asphalt surface like a sanding cloth
  3. Increased noise from the contact of rubber spikes on the road surface

This standard has existed for two years. However, specifically in the traffic rules and the Administrative Code there is no clear regulation on the use of off-season tires, to put it simply, there is no such article there. Such violations are assessed only as a violation of the regulation on the operation of transport, without compliance technical requirements... Minimum the fine in such a situation is 500 rubles.

There are specific indications in this provision that regional adjustments to the norms for the use of seasonal tires are permissible, in different weather conditions. In other words, it makes no sense to use summer tires in permafrost conditions, for example in the north. Since such adjustments can only be of a regional nature, this, in turn, leads to misunderstanding on the part of the traffic police, who may not be aware of such amendments. Also, logic dictates that in the southern regions of the country it would be possible to reduce the period of wearing winter tires, but unfortunately, the regional authorities have more powers to increase this period, and not to reduce it.

If you look at the already existing norms, then it becomes clear the desire of the deputies to introduce just such laws. They (the deputies) are trying to correct these conflicts in the law so that the traffic rules prohibit driving on spikes in the summer months from June to August, and vice versa, a complete ban was imposed on summer tires in the winter from December to February. And the amendments made to the Administrative Code were supposed to form a clear article and a fine of 2 thousand rubles... As you can see, there are no “apocalyptic” changes in the laws, and motorists have nothing to fear.

The tasks facing the deputies urge them to activate these laws starting from December 1, and there are chances for this. The authorities at all levels, as well as the concerned public, all of them support these ideas. You can't joke with the safety of driving in winter conditions, using summer tires, no motives to save money are inappropriate here. Also, the destruction of the asphalt surface in summer must not be allowed by riding on studded winter tires.

Change of tires for winter - when is it legally?

A unified traffic order for the entire territory of the Russian Federation is established by the Traffic Rules. These Rules were approved by the Government Decree of 23.10.1993 No. 1090. When is it necessary to change tires for winter tires according to the law?

The obligation to change tires seasonally is not provided for by the Traffic Regulations or any special Law on winter tires in 2018-2019.

Penalty for winter tires

Despite the fact that traffic rules do not provide for the mandatory seasonal change of tires, we can talk about such a need with reference to Technical regulations TS. At the same time, despite the fact that the specified Technical Regulations answer the question of when to wear winter tires according to the law, there is no responsibility for ignoring the requirements of the regulations. The absence of fines for not using winter tires was confirmed by the traffic police.

Currently, they can be punished not for the absence of winter or summer tires, but for the non-compliance of tires with certain requirements. For example, residual depth The tread pattern of summer tires (in the absence of wear indicators) for vehicles of categories M 1 and N 1 must be more than 1.6 mm, and for winter tires, as mentioned above, more than 4 mm. Tires cannot have external damage (breakdowns, cuts, breaks), exposing the cord, as well as delamination of the carcass, peeling of the tread and sidewalls. By size or permissible load the tires must match the vehicle model. It is also forbidden, for example, to install studded and non-studded tires on a vehicle at the same time (Section 5 of the List of faults and conditions under which the operation of vehicles is prohibited, approved by Government Decree No. 1090 of 23.10.1993). If the traffic police inspector discovers any of these violations, the driver may face a warning or a fine of 500 rubles (part 1 of article 12.5 of the Code of Administrative Offenses of the Russian Federation).
